Terms of service

By using Shop Smart, Wear Confidence, you agree to these terms. They're intentionally short.

1. What Shop Smart, Wear Confidence is

Shop Smart, Wear Confidence is an editorial review and comparison site covering everyday clothing staples: jeans, t-shirts, hoodies, zip-ups, button-ups, sweatpants, sweaters, chinos, shorts, pants, jackets, sweatshirts, polos, tops, dresses and skirts. We research products and write our own comparisons. Star ratings come only from reviews, each rated by the person who wrote it. The founder's own reviews are marked Site founder. Product details and prices are read from brands' own stores and from retail feeds, and they change after we read them. We are not a retailer. We do not sell, fulfill, or ship any items shown on the site. When you buy, you buy from the store named on the button, under its terms. Orders, returns and refunds are between you and that store.

2. Reviews are opinions

Our reviews are opinions, not guarantees. Fabric, sizing, fit, color and quality can vary by production run. Prices, sizes and stock shown here can be wrong or out of date. The store's own page is the authority on specifications, price and availability.

3. Affiliate links

A store link may earn us money through an affiliate network, from a purchase or from the click. This costs you nothing extra. We disclose the affiliate relationship in the site footer and on any page that contains affiliate links.

4. Acceptable use

Don't overload our servers, get around rate limits, moderation holds or bans, or probe the site's security. Don't sign up or post by script, send spam, impersonate Shop Smart, Wear Confidence, or use the site to harass anyone. Search engines and AI assistants that follow our robots.txt are welcome. We may block or rate-limit traffic that looks abusive.

5. Intellectual property

Brand names and logos belong to their owners. We use them only to identify the products we review. Product photos come from the brands' own stores and from retail and affiliate feeds, and are shown to identify the product we link to. If you own an image and want it removed, write in on the Contact page with [LEGAL] in the subject. Our editorial text and site design are © Shop Smart, Wear Confidence.

6. No warranties, and limits on liability

To the extent the law allows, the site is provided as is and as available, without warranties of any kind, including merchantability, fitness for a purpose, accuracy and non-infringement. Our reviews and comparisons are drafted with AI tools, and Ask answers are generated. Any of it can be wrong. Reader reviews, photos and posts are their writers' views. We are not responsible for the stores you visit from here or their terms.

To the extent the law allows, we are not liable for indirect or consequential loss, or for any loss from a purchase decision made using the site, and our total liability to you for any claim is US$100. Nothing in these terms limits a liability the law does not let us limit, or your rights as a consumer. Use your own judgment.

7. Changes

We may update these terms. When we do, we'll change the "Last updated" date above and, for material changes, post a notice on the homepage. Using the site after that date means you accept the new terms.

9. What you write here

This covers anything you send us for publication: a review, a photo, a thread or a post on the boards, a correction. You keep ownership of your words and your photos. By sending them you grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, re-encode, resize, crop, translate, excerpt and show them on this site and where the site appears, such as search results, structured data and link previews, and to let our service providers process them for that. The licence ends when the item comes down, except for copies still in backups. Post only what is yours to post. Anything published is public, and it carries a name: your display name. You must be 16 or over.

Do not post:

Anyone with an account can write a review. A person reads every review before it goes up. The review form does not ask whether you work with a brand.

Anyone with an account can add a photo of a piece, on its own or with a review. A photo must be of the piece, taken by you or shared with the photographer's permission. Anyone recognisable in it must be 18 or over and have agreed. A person checks each one before it goes up, and it shows labelled as a reader photo with your display name.

Anyone with an account can start a thread or reply. A person reads your first post before it goes up, and every post while the boards are small. Outside that hold, what you post publishes when you send it, unread.

We refuse or remove a review only for a reason listed on how we review, never for being negative and never because a brand asked. Threads, posts and photos come down for the same reasons, and a post can come down when someone reports it. If we cut part of a post, the cut is noted on it. We have no duty to monitor what is posted here. If something you posted is up and you want it gone, ask us and it comes down. You are responsible for what you post, and you indemnify us against claims arising from it or from your breach of these terms, to the extent the law allows.

10. Accounts

You need an account to write a review, add a photo, start a thread or post a reply. Reading and saving need none. One account per person, on a confirmed email address. You must be 16 or over. We delete an account we learn belongs to someone under 16. Your display name must be unique. You can change it. Until you set one it is Shopper and a number. A review or a post keeps the name it went up under. You can delete the account at any time from the Account page. Deletion removes the account, the saved data it holds and every photo you added. Any review, thread, post or Look of yours still waiting for a read goes too, and so does a review or Look we turned down or a post you took down. Your published reviews, threads and replies stay up as "(deleted user)", and your shared Looks stay up with no account on them. Take any of them down first from the Account page. After that, each stays up until you ask us to remove it on the Contact page.

We may suspend or close an account, or cut off any feature, if it breaks these terms or the law. If your account ends, section 6, the licence and indemnity in section 9, and section 11 still apply.

11. Copyright notices

If you own the copyright in something published here and believe it was used without permission, send a notice with: the work; the URL of the material on this site; your name, address, phone and email; a statement that you believe in good faith the use is not authorised by the owner, its agent or the law; a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for them; and your physical or electronic signature.

We have not designated an agent with the U.S. Copyright Office yet. Until we do, send notices through the Contact page with [LEGAL] in the subject.

If something you posted was removed after a notice and you believe that was a mistake, send a counter-notice with: the URL where it was; a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification; your name, address and phone; your consent to the jurisdiction of the federal court for your district, or, outside the US, any district where we may be found, and to accept service from the person who sent the notice; and your physical or electronic signature. We pass it to that person and may put the material back 10 to 14 business days later, unless they tell us they have gone to court.

We may pass a notice to whoever posted the material. Anyone who repeatedly infringes loses access.
